{"id":2702,"date":"2019-03-12T12:36:31","date_gmt":"2019-03-12T12:36:31","guid":{"rendered":"https:\/\/finquesmasferrer.com\/2019\/03\/12\/reial-decret-llei-7-2019\/"},"modified":"2019-03-12T12:36:31","modified_gmt":"2019-03-12T12:36:31","slug":"reial-decret-llei-7-2019","status":"publish","type":"post","link":"https:\/\/finquesmasferrer.com\/es\/2019\/03\/12\/reial-decret-llei-7-2019\/","title":{"rendered":"Reial Decret-Llei 7\/2019"},"content":{"rendered":"\n<p>Fa uns dies es va&nbsp;publicar al BOE el Reial Decret-Llei 7\/2019, de l\u20191 de mar\u00e7, de mesures urgents en mat\u00e8ria d\u2019habitatge i lloguer, que recentment ha entrat en vigor aquesta setmana.<\/p>\n\n\n\n<p>Aquest Reial Decret-Llei no t\u00e9 efectes retroactius, pel que no resulta d\u2019aplicaci\u00f3 als contractes d\u2019arrendament signats amb anterioritat a la seva entrada en vigor.<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"alignleft\"><img decoding=\"async\" src=\"http:\/\/finquesmasferrer.com\/wp-content\/uploads\/2019\/03\/image004.jpg\" alt=\"\" class=\"wp-image-1766\"\/><\/figure><\/div>\n\n\n\n<p>Amb aquesta modificaci\u00f3 es recuperen algunes mesures de protecci\u00f3 de les que gaudia l\u2019arrendatari amb anterioritat a la reforma liberalitzadora operada per la Llei 4\/2013, de 4 de juny, de mesures de flexibilitzaci\u00f3 i foment del mercat de lloguer d\u2019habitatges i s\u2019afegeixen algunes noves.<\/p>\n\n\n\n<p>S\u2019estableix l\u2019exempci\u00f3 del pagament de l\u2019ITP als arrendaments d\u2019habitatge per a \u00fas estable i permanent. Recordeu que heu de continuar presentant el model com a exempt davant de l\u2019ATC (Ag\u00e8ncia Tribut\u00e0ria Catalana).<\/p>\n\n\n\n<p>A continuaci\u00f3 us relacionem les modificacions m\u00e9s significatives en mat\u00e8ria d\u2019ARRENDAMENT d\u2019HABITATGE\u2013 l\u2019arrendament per \u00fas diferent del d\u2019habitatge no ha patit modificacions-:<\/p>\n\n\n\n<p>-En el suposat que l\u2019arrendador sigui persona f\u00edsica: s\u2019amplia de 3 a 5 anys el termini de pr\u00f2rroga obligat\u00f2ria a favor de l\u2019arrendatari.<br><br>-En el suposat que l\u2019arrendador sigui persona jur\u00eddica: s\u2019amplia de 3 a 7 anys el termini de pr\u00f2rroga obligat\u00f2ria a favor de l\u2019arrendatari.<br><br>-Com succe\u00efa abans de la reforma de 2013, perqu\u00e8 procedeixi la resoluci\u00f3 per necessitat de l\u2019arrendador persona f\u00edsica, tal circumst\u00e0ncia haur\u00e0 de constar de forma expressa al contracte. Aix\u00ed, un cop transcorregut el primer any de duraci\u00f3 del contracte, no procedir\u00e0 la pr\u00f2rroga obligat\u00f2ria del contracte quan, al moment de la seva celebraci\u00f3, s\u2019hagu\u00e9s fet constar al mateix, de forma expressa, la necessitat per l\u2019arrendador d\u2019ocupar l\u2019habitatge abans del transcurs de 5 anys per destinar-lo a habitatge permanent per ell mateix o els seus familiars en primer grau de consanguinitat o per adopci\u00f3 o pel seu c\u00f2njuge en els suposats de sent\u00e8ncia ferma de separaci\u00f3, divorci o nul\u00b7litat matrimonial.<br><br>-S\u2019amplia d\u20191 a 3 anys el termini de pr\u00f2rroga obligat\u00f2ria prevista a l\u2019article 10 LAU. Perqu\u00e8 no procedeixi aquesta pr\u00f2rroga obligat\u00f2ria, l\u2019arrendador haur\u00e0 de notificar almenys amb QUATRE mesos d\u2019antelaci\u00f3 la seva voluntat de no renovar el contracte, i l\u2019arrendatari haur\u00e0 de notificar amb DOS mesos d\u2019antelaci\u00f3.<br><br>-Tornant a la protecci\u00f3 de la que gaudia l\u2019arrendatari abans de la modificaci\u00f3 de la Llei 4\/2013: l\u2019arrendatari tindr\u00e0 dret a continuar a l\u2019arrendament fins que es compleixin els 5 o 7 anys si l\u2019arrendador \u00e9s persona jur\u00eddica, en el suposat de venda de l\u2019habitatge, i tamb\u00e9 en el suposat de resoluci\u00f3 del dret de l\u2019arrendador per l\u2019exercici d\u2019un retracte convencional, l\u2019obertura d\u2019una substituci\u00f3 fide\u00efcomiss\u00e0ria, l\u2019alienaci\u00f3 for\u00e7osa derivada d\u2019una execuci\u00f3 hipotec\u00e0ria o de sent\u00e8ncia judicial o l\u2019exercici d\u2019un dret d\u2019opci\u00f3 de compra.<br><br>-En el suposat d\u2019arrendador persona jur\u00eddica: les despeses de gesti\u00f3 immobili\u00e0ria i de formalitzaci\u00f3 seran a c\u00e0rrec de l\u2019arrendador.<br><br>-En contractes de fins a 5 anys de duraci\u00f3, o fins a 7 anys si l\u2019arrendador \u00e9s persona jur\u00eddica, el valor de garantia addicional no podr\u00e0 excedir de 2 mensualitats de la renda, ja sigui a trav\u00e9s de dip\u00f2sit o d\u2019aval bancari.<br><br>-Es torna al principi de llibertat de pacte en arrendaments d\u2019habitatge de superf\u00edcie superior a 300 mts2 o de renda inicial superior a 5,5 vegades el salari m\u00ednim interprofessional.<br><br>-En mat\u00e8ria d\u2019actualitzaci\u00f3 de la renda: Durant la vig\u00e8ncia del contracte, la renda nom\u00e9s podr\u00e0 ser actualitzada anualment, en les condicions pactades per les parts. En defecte de pacte expr\u00e9s, no s\u2019aplicar\u00e0 actualitzaci\u00f3 de rendes. L\u2019actualitzaci\u00f3 anual de la renda no podr\u00e0 excedir del resultat d\u2019aplicar la variaci\u00f3 percentual experimentada per l\u2019 IPC.<br><br>-S\u2019introdueix un dret de retracte a favor de l\u2019Administraci\u00f3 en determinats suposats de venda conjunta.<br><br>-En mat\u00e8ria de desnonament d\u2019habitatge: s\u2019introdueix el tr\u00e0mit de comunicaci\u00f3 als serveis socials. La determinaci\u00f3 de la situaci\u00f3 de vulnerabilitat produir\u00e0 la suspensi\u00f3 del procediment fins que s\u2019adoptin les mesures que els serveis socials estimin oportunes per un termini m\u00e0xim d\u20191 mes, o de 3 mesos quan el demandant sigui persona jur\u00eddica.<\/p>\n\n\n\n<p><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Fa uns dies es va&nbsp;publicar al BOE el Reial Decret-Llei 7\/2019, de l\u20191 de mar\u00e7, de mesures urgents en mat\u00e8ria d\u2019habitatge i lloguer, que recentment ha entrat en vigor aquesta setmana.
